Alito Is Not Going Anywhere Yet

Fox News reported that Justice Samuel Alito is not expected to retire this term and has already hired all four of his law clerks for the coming year. Two other sources also said he is not stepping down. That matters because clerks are usually hired well in advance, and while that does not prove retirement plans either way, it is a strong sign that Alito is planning to keep doing his job. In other words, the left may have to keep waiting for its wish list to come true. Tough luck. The Constitution is still getting a seat at the table.

CBS News later reported that Justice Clarence Thomas is not planning to retire this year either. Thomas has long been one of the Court’s most reliable originalists, and his presence remains a major reason conservatives still see the high court as a place where the Constitution can be defended instead of reinvented. The retirement chatter may have sounded exciting to the media crowd, but so far it looks more like wishful thinking than breaking news. If anything, the latest reports suggest the Court’s conservative backbone is not about to vanish just because a few activists would like a different outcome.

What This Means For The Court

If both justices stay on the bench, Trump’s next Supreme Court pick may have to wait. That does not make the stakes any smaller. The Court will remain a central battleground over life, liberty, the border, religious freedom, and the power of the federal government. For conservatives, the big lesson is not to get distracted by rumors before anything actually happens. For Democrats, the bad news is that the conservative justices are not exactly rushing for the exits.
