FCC Chairman Brendan Carr responded by posting a montage on X showing clips from The View that appear to feature the hosts praising Democrats, urging political outcomes, and attacking Republicans. Carr wrote that Disney is arguing the show qualifies as bona fide news and that the FCC will make its decision based on “all relevant evidence and precedents.” In other words, the agency is not supposed to grade the show by vibes, applause lines, or Joy Behar’s facial expressions. It must look at the law, the record, and how similar cases have been handled before.

The Equal-Time Fight Has Real Stakes
This is not just another media food fight, though Washington never misses a chance to serve one with extra gravy. If The View is treated as bona fide news, Disney may have more room to avoid equal-time obligations that could apply to political advocacy or candidate-related programming. If it is not, the network may face tighter rules on how political content is handled. Carr has also said he does not see the FCC as the “speech police,” and that his role is to apply laws passed by Congress. That is an important point. The question is not whether the hosts are allowed to be liberal. They clearly are. The question is whether a program that often sounds like a Democratic campaign green room should receive the same regulatory treatment as a straight news broadcast.
ABC’s Credibility Problem Is Bigger Than One Clip
